The HIPAA Privacy Rule requires healthcare providers to inform patients about the privacy practices of insurance plans and healthcare providers. As such, healthcare providers are required to distribute written material informing the patients of their privacy rights regarding their personal health information. This notice must disclose how our organization may use/disclose an individual’s protected health information (PHI), what the patient’s rights are concerning their PHI, and how the patient can exercise their rights if they feel that their PHI has been violated (ie: process for complaints). 

Kuhn Nursing, Inc., DBA “Mind Menders” is a professional nursing corporation. It is the legal duty/obligation of Mind Menders to safeguard the protected health information of our patients.

How Mind Menders Utilizes Protected Health Information (PHI):

Use of Artificial Intelligence for Notetaking: We may offer the ability to utilize a third party vendor that provides HIPAA compliant artificial intelligence assistance during your appointment. This allows the provider to be fully present with the client due to AI notetaking capabilities. Please inform your provider if you do not wish to utilize AI tools during your appointment. 

Chart Review: Each nurse practitioner employed by “Mind Menders” is overseen by a supervising psychiatrist who is professionally obligated to review patient charts (10% of all charts, chosen at random) on a monthly basis. The purpose of monthly chart review is to provide continued excellence in patient care. As such, the supervising psychiatrist working in collaboration with your nurse practitioner may need to electronically access your patient information. Please be assured that HIPAA remains intact during the chart review process, and that our excellent supervising psychiatrists are bound to the same privacy requirements as the nurse practitioner with whom you meet in your appointment. 

Student Access to Protected Health Information: Mind Menders occasionally collaborates with accredited psychiatric nurse practitioner programs/universities in training the next generation of nurse practitioners. Nurse practitioner students are bound to the same privacy policies as the nurse practitioner with whom you visit. Should you consent to the presence of nurse practitioner student in your care, please note that students will have access to PHI through our electronic health record.

Personal Information Collection: Mind Menders may collect demographic information such as age, gender, and location on a voluntary basis. We use this information to provide you with information regarding services which may be of interest to our clients. 

Third Party Information Sharing: We do not sell or lease client information. Mind Menders may be obligated to disclose PHI if mandated by law or to protect patient safety (or the safety of others). PHI disclosures that are used to track deliveries (ie: medications), electronic health record analysis/customer support, etc. are bound to the same HIPAA requirements as the health professionals with whom you may interact.

‍Tracking Client Behavior: We may track client visits to improve our services and deliver customized content.

Cookies: We may use "cookies" to enhance your experience on our website.

‍Automatically Collected Information: We may gather necessary information to enhance computer hardware/software systems.

‍Security of Your Personal Information: We secure personal information from unauthorized access using SSL. Although we will do our best to keep your PHI private, please be advised that online data transmission in any form cannot be guaranteed as 100% secure.

‍Right to Deletion: All patients have the right to request that we delete your information, though retention of this information may be necessary for legal reasons.

‍E-mail Communications: Mind Menders may contact you via email (announcements, offers, alerts, and communication purposes). Please let us know if you choose to opt out of these communications.

‍Minors: We do not collect PHI from children under 13 without proper authorization from a parent or guardian.

External Data Storage Sites:Data is legally required to be stored with third-party vendors.

‍Rights of California Residents: We acknowledge the rights of California residents' under the California Consumer Privacy Act (CCPA). The CCPA provides us with guidelines as to how PHI can be used and also safeguards the rights of the patient.

‍Changes to our Privacy Policy: Mind Menders reserves the right to modify our Privacy Policy at any time. We will notify clients of any significant changes.
